Puppy Deposit Contract
Following is the contract that we use when a person wants to purchase the pick of a liter of puppies:
Sugarloaf Kennel, hereafter referred to as the Seller, and the purchaser of the dog, hereafter referred to as the Buyer, do hereby enter into the following agreement:
In light of the fact that a liter of puppies is expected to arrive on or around ____________________________, the Buyer has put down a deposit in the amount of ________________. The Buyer agrees to pay the remainder of the balance (_______________) at the time the Buyer picks up the dog. If the puppy is to be shipped, the aforementioned balance along with shipping charges must be paid in full when the puppy is 8 weeks old. The puppy will then be shipped no sooner than when it is 8 weeks old, once full payment is received, and the puppy is certified for travel by a vet. This deposit guarantees the Buyer to get his/her choice of ______________ pick of the expected liter. The gender of puppy the Buyer has reserved is ________________________ and the color is _________________________.
The Buyer has the right to choose the puppy he/she would like to adopt anytime after the puppies are whelped, and preferably by the time the puppies are 6 weeks old. Once the puppy has been selected, the Buyer will chose a collar that will remain on the puppy that the Buyer chose, guaranteeing that the Buyer will get that puppy once it is ready to be adopted. When the Buyer is ready to complete the adoption, the Buyer does have the option to change the his/her choice of a puppy provided that the dog the Buyer would rather have has not already been requested by another party.
The Buyer has been advised that the deposit is non-refundable, except in the conditions outlined in this contract. Should the Buyer decide that the puppies in the liter are not to his/her expectations, no refund will be given on the deposit, but the Buyer will not be required to pay any of the balance.
Should the said liter of puppies arrive, and not contain the gender or color requested by the Buyer in this contract, the Seller agrees to give the Buyer the option to have the pick of the next available liter. Should the Buyer not desire this, the Seller agrees to issue a full refund of the deposit and to release the Buyer from the responsibly of paying the balance.
In the event the that the expecting Dam miscarries the puppies, or that all of the puppies are born with health problems or deformities, the Buyer will be given the option to chose the pick of the next available liter. Should the Buyer not desire this, the Seller agrees to issue a full refund of the deposit and to release the Buyer from the responsibility of paying the balance.
The conditions outlined in this contract are the only conditions for which the Seller is obligated to refund the deposit and release the Buyer from the responsibility of paying the balance. The Seller may at his/her discursion, issue a refund should another condition warrant one.
Furthermore, the Buyer is advised that there is a $40 charge on any returned checks. The Buyer further agrees that if any check written by the Buyer is returned and the full balance as well as the $40 fee is not paid to the Seller, in full, this contract shall become null and void.
